Terms of Service

This is template language drafted from the product's actual data practices, with [PLACEHOLDER] fields to complete. Have qualified counsel review and adapt it before publishing. Nothing here is legal advice.

These Terms of Service (“Terms”) govern your use of Hearing, provided by [COMPANY LEGAL NAME] (“we,” “us”). By creating an account or using the service, you agree to these Terms.

1. The service

Hearing is a practice and communication-coaching tool that simulates immigration and visa interviews and produces practice feedback and reports.

2. Not legal advice

Hearing does not provide legal advice and does not create an attorney–client relationship. It is not a substitute for a licensed immigration attorney, and it does not predict whether any application will be approved or denied. We are not affiliated with USCIS, the U.S. Department of State, or any government agency.

3. Eligibility & accounts

You must be at least 16 and able to form a binding contract. You are responsible for the accuracy of your account information and for safeguarding your credentials and all activity under your account.

4. Subscriptions, billing & cancellation

  • Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe.
  • Plan limits (such as monthly realtime minutes) reset each billing period; add-ons are one-time purchases.
  • You may cancel anytime from the billing portal; access continues until the end of the current period.
  • Except where required by law, payments are non-refundable.

5. Acceptable use

You agree not to misuse the service, including by attempting to:

  • reverse engineer, disrupt, or overload the service or its security;
  • upload unlawful content or content you lack the right to share;
  • use the service to provide legal advice to third parties as if it were a licensed professional; or
  • resell or share access except as expressly permitted (for example, firm workspaces).

6. Your content

You retain ownership of the content you provide. You grant us a limited license to process it solely to operate and improve the service, as described in our Privacy Policy.

7. Intellectual property

The Hearing software, design, and content are owned by [COMPANY LEGAL NAME] and protected by law.

8. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that practice results reflect real interview outcomes.

9. Limitation of liability

To the maximum extent permitted by law, [COMPANY LEGAL NAME] will not be liable for indirect, incidental, or consequential damages, or for any immigration outcome. Our total liability is limited to the amount you paid in the 12 months before the claim.

10. Termination

We may suspend or terminate access for violations of these Terms. You may stop using the service at any time.

11. Changes & governing law

We may update these Terms; continued use after changes constitutes acceptance. These Terms are governed by the laws of [STATE / COUNTRY], without regard to conflict-of-laws rules.
